Terms of Service and Return Policy
1. Introduction

Welcome to Dana Ridenour Gallery (“Gallery”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your use of our services—including in‑gallery purchases, online sales, exhibitions, commissions—and your relationship with us. By purchasing from us, entering into an agreement, or otherwise using our services, you agree to these Terms.

2. Definitions

Artwork means any original works of fine art, prints, commissioned pieces, sculptures or similar items sold or exhibited by the Gallery.

Customer means any person or entity purchasing or commissioning Artwork, or using any services offered by the Gallery.

Sale means the transfer of ownership of Artwork from the Gallery to the Customer in exchange for payment.

3. Ordering, Payment & Sales

Orders may be placed in person at our gallery, via phone, email, or through our website (if applicable).

Prices are as listed at time of purchase; Subject to change without notice. All Sales are subject to applicable taxes (e.g. California sales tax).

Payment is due upon purchase (or according to any prior written agreement for commissions). Acceptable payment methods: [e.g. credit card, check, cash, etc.].

Deposits: For commissioned works or special orders, a non‑refundable deposit (e.g. 50%) may be required prior to beginning work. Remainder due upon completion or as agreed.

4. Shipping, Delivery, & Risk

If Artwork is shipped, the Customer is responsible for shipping costs, insurance, and packaging unless otherwise agreed in writing.

Risk of loss passes to the Customer once the Artwork leaves the Gallery or is delivered to the carrier. Gallery is not responsible for damage or loss in transit if the customer has selected the carrier.

If delivery is delayed for reasons beyond our control (e.g. customs, carrier), we will communicate with you and assist but shall not be liable for delays.
5. Returns & Refunds
We strive for customer satisfaction, but as Artwork is often unique, there are special conditions. Please read carefully.
a. General Return Policy

Eligibility window: If a purchase is not a custom / commissioned work, you may request a return within 14 days of delivery or pickup.

Condition: The Artwork must be returned in its original, undamaged, unaltered condition, with all documentation, packaging, and any certificates of authenticity intact.

Return Authorization: All returns must be pre‑authorized by the Gallery. You must contact us at danaridenourart@gmail.com to request a return authorization number.
b. Non‑Returnable Items
The following are not eligible for return or refund:

Custom or commissioned works which were made to your specifications;

Any artwork marked “Final Sale” or “As Is”;

Digital downloads, unless specified otherwise;

Items that have been altered, damaged, framed (if framing was part of the purchase and installation), or otherwise changed after delivery in any way not agreed by the Gallery.
c. Process and Refunds

Once you request a return and receive a return authorization, you must ship (or bring) the Artwork back at your expense (unless the return is due to damage or error by the Gallery). The return must be shipped with appropriate insurance and tracking.

Upon receipt, we will examine the returned Artwork. If accepted, we will issue a refund to your original method of payment within 30 days. Shipping fees and restocking fees (if any) may be deducted.

If the return is due to damage or mis‑description (i.e., our error), the Gallery bears the cost of return shipping, and full refund is issued (including shipping).
d. Restocking Fee
A restocking fee of up to 15% of the purchase price may apply for returns not involving damage or error, to cover inspection, repackaging, and administrative costs.

6. Cancellations

If you place an order or commission, and then wish to cancel, please notify us in writing as soon as possible. If work has begun on a commissioned piece, cancellation may incur costs or partial forfeiture of deposit.

For regular inventory items not yet shipped or picked up, cancellation is possible if you notify us before shipment/pickup. After shipment/pickup, return policy governs.

7. Intellectual Property

All content on our website, catalogs, images, and related materials are protected by copyright and other intellectual property laws. Use is permitted only as authorized.

Purchase of Artwork does not transfer reproduction rights, unless explicitly agreed in writing.

You may not reproduce, distribute, or publicly display the images or reproductions of Artwork beyond personal, noncommercial use unless permitted.

8. Limitation of Liability

The Gallery makes no warranties other than those explicitly stated in these Terms.

To the fullest extent permitted by law, the Gallery shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to its services or Artwork.

Our total liability for any claim under these Terms shall not exceed the price paid for the specific Artwork or service at issue.

9. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California.

Any disputes arising hereunder shall be resolved in the courts of Orange County, California.

If any provision is found invalid or unenforceable, the remainder of the Terms shall continue in full force.

10. Changes to Terms
​
We reserve the right, at our discretion, to modify or replace these Terms at any time. If a change is material, we will provide notice (e.g. via website or email) prior to its effective date. Continued use or purchase constitutes agreement to the revised Terms.
